DRAWING RULES
NO PURCHASE NECESSARY
No purchase is necessary to enter or to win this drawing (the “Drawing”).
PRIZE
Description of prize: One (1) Gutai: Splendid Playground catalogue and two (2) admission tickets to the Guggenheim Museum.
Value of prize: ($109)
HOW TO ENTER
Entries into the Drawing may be made by: (i) either visiting http://www.facebook.com/guggenheimmuseum OR http://twitter.com/guggenheim, OR e-mailing community@guggenheim.org; and (ii) submitting a question for exhibition cocurators Alexandra Munroe and Ming Tiampo on Gutai: Splendid Playground, between 10 am EST on Monday, March 4, 2013 and 5 pm EST on Friday, March 8, 2013.
Entries are limited to one (1) submission per entrant across all three entry methods for purposes of the Drawing; anyone who enters multiple times across entry methods will be counted as a single entry.
ELIGIBILITY
This Drawing is open only to legal residents of the United States of America who are at least 18 years of age. Employees, officers and directors of the Solomon R. Guggenheim Foundation (the “Organizer”) and its affiliates, their advertising and promotion agencies, and their respective immediate families (or persons living in their same households) are not eligible to win. This Drawing is void where prohibited by law and subject to all federal, state, and local laws and regulations. You must have access to the Internet and a valid email address in order to enter the Drawing. Anyone found to use multiple Twitter accounts to enter the Drawing will be deemed ineligible.
Participation in this Drawing constitutes full and unconditional acceptance of the rules set forth here and the additional rules set forth below under the section Additional Rules (together with these rules, the “Official Rules”), and agreement to be bound by these Official Rules and the decisions of the Organizer with respect to the Drawing.
SELECTION AND NOTIFICATION OF WINNER
The Organizer will select one (1) winner by conducting a random drawing on or about Monday, March 11, 2013 from all eligible entries received by the entry deadline. The winner will be notified by e-mail, Twitter direct message, or another electronic communication method. If the winner does not respond to notification by email within seventy-two (72) hours, or if any prize or notification is returned as undeliverable, an alternate winner will be selected from the remaining eligible entries received.

The definition of “Releasees” in the “Release” section of the Official Rules shall include Facebook, Inc. This Drawing is in no way sponsored, endorsed or administered by, or associated with, Facebook, Inc. Entrants acknowledge that s/he is providing information to Organizer and not to Facebook, Inc.

1. ORGANIZER

2. PRIZE
Prizes
are nontransferable and cannot be exchanged for cash. There are no
substitutions for a prize. Arrangements for the delivery of the prize
will be made by the Organizer.
Any
taxes due as a result of winning a prize, and the payment of any other
expenses or incidentals not specified herein, are the sole
responsibility of the winner. All winners agree: (i) to sign and return
to the Organizer any tax forms that the Organizer may require; and (ii)
that the Organizer may use his or her name, photo and likeness for
publicity purposes without further compensation or consideration.
3. ODDS OF WINNING
The odds of winning a prize are dependent on the total number of eligible entries received.
4. USE OF INFORMATION
By
entering the Drawing: (i) you agree that your entry and any other
personally identifiable information collected or used in connection with
the Drawing may be used by the Organizer in accordance with the Privacy
Policy posted at http://www.guggenheim.org/privacy-policy/;
(ii) you acknowledge that you have read and accepted the Organizer’s
Privacy Policy; and (iii) you automatically opt-in to receive
information about the Organizer.
5. GENERAL CONDITIONS
The
Organizer reserves the right to disregard any entry that is incomplete
or incorrect. All entries become the Organizer’s property and will not
be acknowledged or returned.
The Organizer is not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind (whether technical or human), lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit any entrant’s ability to enter the Drawing, or the processing of the entries in this Drawing, including any injury or damage to entrant’s or any other person’s computer relating to or resulting from participating in this Drawing.
In case of dispute as to the identity of any entrant, the entry will be declared made by the Authorized Account Holder of the contact information submitted at time of entry. “Authorized Account Holder” is defined as the natural person who is assigned, or registers for, a contact (including without limitation, an email address or a username) by or from an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning such a contact or the domain associated with the submitted contact. Any potential winner may be requested to provide the Organizer with proof that such winner is the Authorized Account Holder associated with the winning entry. Any other attempted form of entry is prohibited; no automatic, programmed; robotic or similar means of entry are permitted.
If for any reason the Drawing is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Drawing, the Organizer reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Drawing. In such case, the Organizer may select the winner(s) from all eligible entries received prior to and/or after (if appropriate) the action taken by the Organizer.
The
Organizer reserves the right, in its sole discretion, to disqualify any
entrant found to be: (i) tampering or attempting to tamper with the
entry process or the operation of the Drawing in any way; (ii) violating
the Official Rules; or (iii) acting in an unsportsmanlike or disruptive
manner, or with the intent to annoy, abuse, threaten or harass any
other person. Any false information provided within the context of the
Drawing by any entrant concerning identity, contact information, or
email address and/or non-compliance with Official Rules may result in
the immediate elimination of the entrant from the Drawing. The Organizer
further reserves the right to disqualify any entry that it believes, in
its sole discretion, infringes or violates the rights of any third
party or otherwise does not comply with the Official Rules. CAUTION: ANY
ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE
THE LEGITIMATE OPERATION OF THE DRAWING MAY BE A VIOLATION OF
CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE ORGANIZER
RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST
EXTENT PERMITTED BY LAW.
6. RELEASE
By
participating in the Drawing, each entrant releases the Organizer, its
advertising and promotion agencies, and their respective affiliates,
trustees, directors, officers, employees, representatives, and agents
(collectively, the “Releasees”) from any and all liability for any
claims, costs, injuries, losses or damages of any kind arising out of,
resulting from, or in connection with: (i) the Drawing, including
without limitation, any technical or Internet malfunctions or human
error of any kind which may occur in the processing of entries in the
Drawing; (ii) the acceptance, possession or use of any prize awarded;
and (iii) any claims based on publicity rights and merchandise delivery.
7. GOVERNING LAW
The
Drawing is governed by and construed and enforced in accordance with
the laws of New York State, without regard to its choice of law
provisions. Any case, controversy, suit, action, or proceeding arising
out of, in connection with, or related to this Drawing shall be brought
in federal or state court located in New York County and the State of
New York. By participating in the Drawing, the entrant hereby consents
to the jurisdiction of these courts. Any and all claims, judgments, and
awards shall be limited to actual damages.
